General Terms and Conditions.
KRASO Padel Arena | Operator: Krasemann + Krasemann Invest GmbH
§ 1 Operator and Scope of Application
(1) These General Terms and Conditions (T&Cs) apply to contracts for services provided by Krasemann + Krasemann Invest GmbH, Baumannweg 1, 46414 Rhede, registered in the Commercial Register of the Coesfeld District Court under HRB 23837 (hereinafter referred to as the “Operator”), which are offered under the KRASO Padel Arena brand at its locations in Rhede, Borken, Emden, and other locations operated by it.
(2) These T&Cs apply to court bookings, paid rental of padel rackets, sale of goods on site, tournaments and league offers, as well as individually arranged corporate and group events. For the use of offers from external partners, the regulations in § 12 apply.
(3) Insofar as house rules are effectively incorporated into the contract, they must also be observed. Individually agreed arrangements take precedence over these T&Cs.
§ 2 Court Booking and Contract Conclusion via Playtomic
(1) Regular court bookings are made exclusively via Playtomic. For the setup and use of the Playtomic account, the platform functions, and fees collected by Playtomic itself, the effectively agreed terms of use apply. These are available at https://playtomic.com/legal-conditions.
(2) The Operator provides the booked court service. Booking is done through the booking process in Playtomic. The contract is concluded upon confirmation of the booking, unless a different explicit agreement on the time of contract conclusion is made during the booking process.
(3) The location, court, booking time, scope of services, and price displayed before completing the booking and subsequently confirmed are decisive. For open matches, the effectively agreed Playtomic rules for participation, cancellation, and, if applicable, automatic cancellation also apply.
§ 3 Prices and Payment
(1) For court bookings, the final prices displayed in the booking process, including statutory VAT, apply. Prices may vary depending on location, court type, weekday, and time.
(2) Payment for regular court bookings is made via Playtomic. If Playtomic allows for a total payment or a split among multiple players, the payment models offered there can be used. The processing of outstanding payment portions is governed by the effectively agreed conditions of the respective payment model.
(3) Service and transaction fees charged by Playtomic for its own services are levied according to the applicable conditions and are shown in the booking process. Prices for goods and racket rental are displayed at the vending machine or point of sale before the respective transaction is completed.
§ 4 Cancellation, Refund, and No-Show
(1) Regular court bookings can be canceled via Playtomic up to 24 hours before the start of the booked playing time. In this case, the Operator will refund the full court rental fee via the designated payment method.
(2) For cancellations less than 24 hours before the start of play or in case of a no-show, the court rental fee will generally not be voluntarily refunded, provided the booked service is made available as per contract. Statutory claims remain unaffected.
(3) The refund of independent fees from Playtomic is governed by the effectively agreed platform conditions. For open matches, the explicitly agreed Playtomic match and cancellation rules apply.
(4) Late arrival does not entitle the customer to an extension of the booked playing time.
§ 5 Playing Time, Access, and Participation of Minors
(1) The booking entitles the user to use the booked court during the confirmed playing time. The court must be vacated immediately at the end of the playing time.
(2) Access to the arena is granted via the access code provided by Playtomic or the connected access system. The code is intended exclusively for persons authorized for the respective booking. It may not be passed on to unauthorized third parties. Its validity period is determined by the technical settings of the access system.
(3) Co-players and spectators may enter the facility within the applicable opening and access hours. Spectators are not thereby entitled to independent use of a court. The arena must be vacated by 10:30 PM at the latest.
(4) Minors may only make paid bookings with the consent of their legal guardians. Children under twelve years of age are only permitted to use the facility and courts under the supervision of an adult.
§ 6 Failure, Restrictions, and Technical Malfunctions
(1) If a booked court cannot be used as per contract due to a defect, technical malfunction, or necessary closure, the Operator will, if possible, provide an equivalent replacement court. If no equivalent replacement is available or if it is unreasonable for the customer, the remuneration for the unrendered service will be appropriately refunded. Further statutory claims remain unaffected.
(2) Defects, failed access attempts, damages, and hazards must be reported immediately at 02872 / 9535-800 or via the contact option provided at the location. In case of acute danger, general emergency numbers must be used.
(3) The Operator may temporarily close individual areas or courts for specific safety reasons. Statutory claims for unrendered services remain unaffected.
§ 7 Rental and Return of Padel Rackets
(1) Padel rackets, if available, are dispensed and returned for a fee via a rental and return machine. Rental price, rental period, and payment method are displayed at the machine before the start of the rental.
(2) The rented racket must be used carefully and as intended during the rental period and returned via the designated machine by the agreed return time at the latest.
(3) In the event of damage or loss caused by fault, the renter is liable according to statutory provisions. Ordinary wear and tear from contractual use is not compensable damage. (4) If a proper return is not possible due to a technical malfunction of the machine, this must be reported immediately via the contact option provided at the machine. A demonstrably reported technical malfunction does not result in a culpable late return.
§ 8 Sale of Balls, Padel Items, Drinks, and Snacks
(1) Padel balls and other padel items are sold exclusively on site. Drinks and snacks are offered via the Operator’s vending machines. The prices and product information displayed at the time of purchase apply.
(2) If a paid item is not dispensed by the machine or if an incorrect charge occurs, the customer can report the incident via the contact option provided at the machine or in the arena and assert their statutory claims.
(3) Statutory warranty rights apply to all purchases of goods. An additional voluntary right of exchange or return for defect-free goods purchased on site is not granted.
§ 9 Tournaments and League Play
(1) For tournaments and league offers, the participation conditions and announcements published before registration apply in addition. These regulate, in particular, participation requirements, registration deadlines, game mode, participation fees, and withdrawal options.
(2) If registration or payment is made via Playtomic, its effectively agreed conditions also apply to the relevant platform functions.
(3) If an event has to be canceled or significantly changed, the Operator will inform registered participants and, if possible, offer a suitable alternative. Statutory claims for repayment and other rights remain unaffected.
§ 10 Corporate and Group Events
(1) Corporate and group events are offered upon individual request and booked outside of Playtomic. A contract is concluded upon acceptance of a binding offer from the Operator.
(2) The type and scope of services, date, number of participants, remuneration, payment terms, and cancellation options are based on the accepted offer and effectively agreed supplementary event conditions.
(3) If the Operator cannot carry out a contractually owed event, it will offer an alternative date if possible. If no mutually agreed alternative solution is reached, payments for unrendered services will be refunded. Further statutory rights remain unaffected.
§ 11 Damages and Reporting Obligations
(1) Anyone who culpably damages the Operator’s facilities, courts, machines, rented items, or other property is liable according to statutory provisions.
(2) Damages, malfunctions, or recognizable hazards must be reported immediately via the provided contact option.
(3) Statutory provisions apply to personal belongings and the use of lockers. The provision of lockers does not establish a special duty of safekeeping without a separate agreement.
§ 12 Partner Offers
(1) Offers via EGYM Wellpass, Epassi, or other cooperation partners can only be used by persons authorized for the respective partner program and only at locations where the corresponding offer is actually available.
(2) The scope and prerequisites of the partner offer, any required check-ins, additional payments, and partner-related booking or cancellation rules are governed by the conditions of the respective partner, which were published before use and effectively agreed upon. These T&Cs also apply to services directly provided by the Operator.
§ 13 Operator’s Liability
(1) The Operator is liable without limitation for damages resulting from injury to life, body, or health caused by an intentional or negligent breach of duty by the Operator, its legal representatives, or vicarious agents, as well as for other damages resulting from intent or gross negligence.
(2) In the event of a slightly negligent breach of material contractual obligations, the Operator is liable for the foreseeable damage typical for the contract. Material contractual obligations are duties whose fulfillment enables the proper execution of the contract and on whose observance the contracting party may regularly rely.
(3) Otherwise, liability for property and financial damages caused by slight negligence is excluded, to the extent legally permissible. Mandatory statutory liability provisions remain unaffected.
§ 14 Right of Withdrawal and Statutory Claims
(1) For the booking of courts for a specific date or period, there is generally no statutory right of withdrawal for contracts concerning leisure services, in accordance with § 312g para. 2 no. 9 of the German Civil Code (BGB). The voluntarily agreed cancellation option under § 4 remains unaffected by this.
(2) For other types of contracts, any rights of withdrawal are governed by statutory provisions. Statutory rights regarding defects, performance disruptions, and damages remain unaffected.
§ 15 Data Protection and Final Provisions
(1) Information on the processing of personal data by the Operator is contained in the separate data protection notices. For processing by Playtomic or other independently responsible parties, their respective data protection notices apply.
(2) German law applies. For contracts with consumers habitually residing in another country, mandatory consumer protection regulations of that country remain unaffected.
(3) Statutory rules on jurisdiction apply to disputes. A deviating agreement on jurisdiction is only valid if it is legally permissible and effectively agreed upon.
